Terms and Conditions
1. Application of Terms
These Terms and Conditions (“Terms”) apply to all memberships, class packs, casual sessions, introductory offers, on-demand services, and any other services provided by Afiyah Pilates Limited (“Afiyah Pilates”, “we”, “us”, “our”).
By purchasing, booking, attending, or participating in any Afiyah Pilates service, you confirm that you have read, understood, and agree to be bound by these Terms.
We reserve the right to amend these Terms at any time. Updated Terms will be published on our website and will apply from the date of publication.
2. Eligibility and Studio Access
2.1 Afiyah Pilates is a women-only studio. Services are available exclusively to individuals who identify as women.
2.2 The minimum age to participate is 16 years. Proof of age may be requested.
2.3 Afiyah Pilates reserves the right to refuse service, cancel bookings, or terminate memberships if eligibility requirements are not met. Any fees paid may be refunded at our discretion where access is denied due to eligibility.
3. Compliance with New Zealand Law
These Terms are governed by the laws of New Zealand, including (without limitation):
Consumer Guarantees Act 1993
Fair Trading Act 1986
Privacy Act 2020
Nothing in these Terms limits or excludes any rights that cannot lawfully be excluded under New Zealand law.
4. Memberships, Packs, and Services (General)
4.1 All memberships, class packs, and sessions are prepaid and must be paid in full prior to attendance.
4.2 Prices are stated in New Zealand Dollars (NZD) and include GST where applicable.
4.3 Except as required by law or expressly stated in these Terms, all purchases are non-refundable.
5. Booking, Cancellation, and No-Show Policy
5.1 Bookings must be made via our booking system or app.
5.2 A minimum of 12 hours notice is required to cancel any class or session. Minimum 6 hours notice apply for on-demand sessions.
5.3 Late cancellations (less than 12 hours notice for Instructor led classes and 6 hours for on-demand) and no-shows will result in forfeiture of the session with no refund or credit.
5.4 Late arrival may result in refusal of entry. Entry after 10 minutes after the class commencement, is at the instructor’s discretion only.
6. Changes, Hold & Upgrades
6.1 During any minimum commitment period, memberships may not be cancelled or downgraded.
6.2 Upgrades to higher-tier memberships are permitted at any time.
6.3 Membership freezes are permitted for up-to 2 weeks during the initial commitment period. Any further hold requests to place a membership on hold is subject to the sole discretion of Afiyah Pilates.
6.4 Classes and sessions included in a membership are allocated on a weekly basis and must be used within the applicable week. Unused weekly classes cannot be transferred, rolled over, accumulated, or exchanged for future weeks, credits, or refunds.
7. Transfers
7.1 Memberships are strictly non-transferable.
7.2 Class packs may be transferred once, provided no sessions have been used, subject to approval and administrative conditions.
8. Studio Conduct
Members must comply with all studio rules, instructor directions, and safety guidelines. Afiyah Pilates reserves the right to refuse service or terminate access where conduct is unsafe, disruptive, or inconsistent with studio values.
9. Limitation of Liability
Except as required by law, Afiyah Pilates shall not be liable for loss, damage, injury, or death arising from participation in services.
2. PLAN-SPECIFIC TERMS
(Each membership plan and class pack follows the general Terms above, with the following specific conditions):
3-Month Instructor-Led Reformer Membership
Minimum commitment: 3 months
Cancellation: 28 days written notice within contract term
Upgrades allowed during the contact term, downgrades can only be done at renewal
Fees non-refundable except medical or statutory reasons
3-Month On-Demand Membership
Minimum commitment: 3 months
Cancellation: 28 days written notice within contract term

Access limited to kiosk-based on-demand sessions only
10-Class Pack (Instructor-Led Reformer)
Valid 2 months from first use
Unused sessions expire without refund

3. PRIVACY POLICY
(NZ Privacy Act 2020 Compliant)
Afiyah Pilates Limited collects, uses, and stores personal information in accordance with the Privacy Act 2020.
Information Collected
We may collect:
Name, date of birth, contact details
Health information relevant to exercise safety
Payment and booking details
Use of Information
Information is used to:
Deliver services
Manage memberships and bookings
Communicate service updates
Comply with legal obligations
Disclosure
Information may be shared with third-party service providers (e.g. booking software, payment processors) strictly for business operations and subject to confidentiality obligations.
Rights
Under the Privacy Act, you have the right to request access to and correction of your personal information held by Afiyah Pilates. If you wish to review, update, or delete your information, please reach out to contact@afiyahpilates.com
4. LIABILITY WAIVER & RISK DISCLOSURE
Medical Disclaimer
Participating in Pilates exercises carries inherent risks of injury. Before starting any new exercise program, consult your doctor or healthcare provider to ensure it is safe for you. You must inform Afiyah Pilates and our instructors of any pre-existing medical conditions, injuries, or pregnancy before participating. We recommend obtaining medical clearance if you have any doubts. It is your responsibility to evaluate your own fitness level and to stop exercising if you feel pain, discomfort, or any adverse symptoms during a session.
Assumption of Risk
You understand and agree that participation is at your own risk. Afiyah Pilates instructors will demonstrate and correct exercises, but you are responsible for adjusting intensity and stopping if needed. Instructors may provide hands-on assists to ensure proper form, which you consent to as part of instruction. We are not responsible for injuries caused by your personal equipment or failure to follow guidance.
Release of Liability
You hereby release and do not hold Afiyah Pilates (including its owners and employees) accountable, from any and all claims for injury, loss, or damage arising from your participation in classes or use of our facilities, to the fullest extent permitted by law. This includes any injury or accident occurring on studio premises or during an in-studio class or on-demand session.
Acknowledgment
By enrolling in any plan, you acknowledge that you have read these Plan-Specific Terms, the main Terms and Conditions, the Privacy Policy, and the Liability Waiver, and agree to abide by all of them.
